抄録	研究成果の概要 (和文) : 本研究の中心的な成果は、「領域国の意思・能力の欠如」理論（‘unwilling or unable’ doctrine）に関連する。これは、一般に、テロ攻撃などの武力行為をなす非国家行為体に対して、その所在する国家（領域国）が実効的に対処する意思または能力を欠く場合には、武力行為の被害国は領域国の同意を得ずに域内で武力を行使して自ら脅威に対処することができる、という法命題として理解されている。本研究は、非国家行為体に対する越境軍事行動を法的に正当化する従来の議論との関係で、意思・能力欠如理論が連続性と非連続性の双方を有するものであることを明らかにした。
抄録	研究成果の概要 (英文) : This research aims at clarifying the so-called ‘unwilling or unable’ doctrine in the contemporary international law discourse. Authors who support this doctrine argue that the use of force by a state against non-state actors in the territory of another state is legal when the territorial state is unwilling or unable to suppress the armed activities by non-state actors within its territory. Although this doctrine does not constitute a departure from the traditional discourse on the interpretation of the relevant provisions of the UN Charter, it attempts to justify the use of force by states with reference not only to national security interests but also to the common interest of international community, i.e. counter-terrorism.
