抄録	研究成果の概要 (和文) : 本研究は、遂行者が従来取り組んできた「支援型法」に関する実践的考察として、判断能力不十分者の自己決定権の実質的保障（ひいては、判断能力不十分者に対する自己決定支援）に関する法的枠組みについて、英国（2005 年英国意思決定能力法）と日本の成年後見制度を題材として比較法的考察を試み、主観的な意味での「ベスト・インタレスト」概念を基軸に据えて理論的分析を行うとともに、社会の意識変化に一定の影響を与えた。
抄録	研究成果の概要 (英文) : In this project I have been researching on a legal framework where the right of people with mental disabilities to self-determination could be further enhanced. In such a legal system of “supported decision-making”, it will be expected that people who have difficulties in deciding by themselves could have sufficient support from others (i.e. guardians) who are also supported by “facilitating law” (e.g. giving protection from excessive liabilities). Throughout this project the concept of “best interest” in Japanese law has been analyzed in great detail, particularly as compared with the UK’s Mental Capacity Act 2005, It is to be hoped that social awareness of the importance of “wishes” of the person, no matter how limited his/her mental capacity would be, has been increased by this project.
