The purpose of this paper is(1) to describe how"nondiscrimination"and"universal access"of the Workforce Investment Act (WIA) of 1998 work inthe relation of the state and local boards which are in charge of its executionand(2)to examine its principle to give a suggestion to Japan's labor policy.While pre-existing studies on WIA written in Japanese point out its characteristicsas devolutionalism and neo-liberalism, this paper tries to explore thepossibility to realize social justice from the local level."Federal Rules" states that it is unlawful for the One-stop system to usedemographic characteristics to decide which individual should receive itsservice, but that state and local boards of WIA should take reasonable effortsso that they must outreach any type of individual. In addition, WIA sets theaction of the Secretary of Labor and the Attorney General, which means thatcivil actions will take place anytime, therefore the state and local boards aresupposed not to fail to outreach the eligible population.South Central MichiganWorks!(SCMW!), one of the locals of the MichiganState system, required its training providers to keep "characteristicminimum," which reflects its demographic characteristics, of the participantsof the programs. But to keep "characteristic minimum" guarantees neithersubstantial outreach nor universal access. Realizing these social values needstrial and errors of those who really want to solve the social problems such ascommunity based organizations and organizations for minority's rights. To adaptfundamental rules formally does not raise and keep the quality of outreach.However, the principle that nondiscrimination and universal access of WIAjustifies their existence and action legally requires the state and local boardsof WIA serious effotrs. This gives an important suggestion to the Japan'spolicy for the job placement and training for the socially and economicallydisadvantaged, because the related laws are written only in the "language ofeconomism." If we hope that the policy will bring about desirable effects, therelated laws must be written also in the "language of social justice," for itjustifies and strengthens non-profits and social enterprises undertaking thejob placement and training.
